The State Environmental Policy Act (SEPA)  process identifies and analyzes environmental impacts from governmental decisions. These decisions may be related to issuing permits for private projects, constructing public facilities, or adopting regulations, policies, or plans. SEPA review helps agency decision-makers, applicants, and the public understand how a proposal will affect the environment. SEPA can be used to modify or deny a proposal to avoid, reduce or compensate for probable impacts.

Insights from Neal Friedman:

We need to make sure we know when the SEPA comment period opens up.  I *think* that everyone who is a Party of Record will get a SEPA notice, but someone should confirm that.

Everyone should look at the SEPA checklist form on the Snohomish PDS WEB site.  This is a good tutorial on what the process is, and will give people ideas on what sorts of information we can submit.

I have written two SEPA checklists  myself, one for King, one for Snohomish.  I had professional help with parts.

I also propose that the we, as the organization, put together a master SEPA rebuttal, with as many good ideas as we can collect.   My suggestion, as a way to structure our efforts,  is that we  collectively fill out a SEPA checklist of our own, making sure to put all the negatives in.  The developer will try to use their own (dare I say “alt facts” ??) to spin the project in the best light.   We can then compare our answers with their answers as a rebuttal.

Everyone is of course encouraged to submit their own comments, but we should do one as an organization.

King5: Maltby residents worry massive apartment complex will ruin quality of life

MALBY, Wash. – Jeffrey Moidell left the big city of Seattle for the quiet community of Maltby to get away from the craziness.

“You can clear your head with all this space. You can breathe,” he said. “You can see the stars at night.”

But now he fears that craziness is coming to him.

A massive apartment complex is proposed near the intersection of Highway 522 and Paradise Lake Road in Snohomish County. An Arizona-based developer wants to build a 17-acre site comprised of 15 three-story buildings totaling 360 units.

*The first school was built on Mayer’s property, one of the out buildings might be it.

*Microfiche has a picture but not the location, small, was not there very long  Maybe check back with the Heritage to see if they have any information with it (Roseanna Rodman).

*A couple of buildings on the property are possibilities. Viewed overhead of the property, was located as being on Paradise Lake and Yew.

*Jeff Moidel wants to get pictures of the location. The greenhouse on the property was removed already, not sure when.

*The demolition notice has been posted.  The demolition company is Katerra Construction LLC out of California. Need to call and see if we can find out any details (Roseanna Rodman) must be completed by 1/2018

*Need to look into the historical aspect of entire area, including the other side of the highway (the gymnasium, church, historical downtown see if there is any chance to make it a historical site. (Veronica jassman)  

 

Environmental Committee:

Concerned with details which would affect the natural environment, approximately 17 members – will have some overlap with Traffic, Utilities and Urban growth Committees

How SEPA works:

  • The developer fills out the SEPA questionnaire and distributes it to the County who passes copies to others that may be involved State Fish & Wildlife, Tribes, Public Health, etc. ,
  • There has to be a public comment period, large signs should be posted which gives you 20 days to comment – you can submit by email –
  • Once the permit is submitted the County has 120 days to respond, if the developer does not like the response they can go back.  

Note: Developer may choose to delay the process hoping to come up with something positive like on the traffic issue.  We need to pull out county data (Public Works) on surface water, or the seasonal stream, They are required to evaluate every 6 years, it is public information.

Water: Laura looked at the aquifer, and it appears as though Cross Valley has plenty of water if managed correctly.

Note: Susanne Winter, works for State Dept of Ecology, pointed out that the SEPA checklist submitted to the county (it shows up as part of the application on the county website) was provided to the county as the lead agency, but it has not been submitted for comments yet to the public or other agencies like Ecology. She is watching for it.

Critical Areas: There is a seasonal stream and a pond (very close to the southeast footprint of their building number 14) The pond is approximately 15 X 20’. Constance Rogers and Susanne have taken pictures of the pond, but it is frozen and no water was running out of it.  After we get some rain, there will be running water and they will take pictures of that. The overflow areas is in the 25’ buffer zone. It moves west then south toward the planned detention pond. The SEPA checklist says there is no seasonal stream and no pond.

Constance also spotted what appears to have been a hand dug well near the pond with a cement casing. Susanne, who lives next door (East0 to the project, experiences drainage problems on her property, flowing from the proposed apartment site.

No detention pond is shown along the West (downslope) side of the property.  Apparently, the drainage has been disapproved by the county.  We need to learn why.

We need to post a list of things that need to be watched for and communicated about as the project starts to move forward, timing is very important

Future Actions:

  • Watch for Critical Areas paperwork  to be submitted
  • Review the SEPA checklist and answer every questionable point
  • Get input from Crystal Lake homeowners association and any environmental studies specific to Crystal Lake and its surrounding wetlands which could cast light on potential harm to water quality, salmon habitat
  • Obtain letters from supportive local environmental advocacy groups (Bear Creek Headwaters, Water Tenders, Echo Paradise Community, Futurewise, others
  • Find credible sources who can speak to the issue of road runoff and increased air pollution, noise pollution from increased traffic along Paradise Lake Road and Paradise Valley Conservation Area
  • Research what type of soil is on the site, possible through the Snohomish Conservation Org, they can’t take sides but can provide data

Organization Committee:

Need Someone to take over Committee Lead position, Bekie is due to have her baby soon and is also going to be in Cambridge in the Fall for a year.  Jeff Lupp has switched to the Legal Committee.

Need clarification on communication for the Committees

  • Who is in charge of what,
  • Organizing the email lists for the Committees and keeping them current
  • Who is doing the communicating for each committee and is responsible for setting meetings and sending emails
  • A record of tasks delegated in each Committee and follow-up on those tasks
  • If you are the leader of the committee you are responsible to call meetings of  your group and communicating the status of the committee to the Leadership group.  

Note:  We need to be seen as taking action and doing something to hopefully help the vandalism problem the site is currently having.

 

By Wednesday every week we need to update each other even if to say there is no update.

Next Meeting:

  • Can utilize the Maltby Community Center, they have Tuesday open (Jennifer to check out)
  • We can use the Church Assembly’s meeting room
  • Woodinville Real estate office has a large meeting room.
  • A decision will be made and leads notified by the Organization Lead.

 

Fund Raising Committee:

Can’t talk about fundraising until form a 501C, not sure who is the lead

  • Requires a board of directors, 2 officers (President & Vice President) a Secretary and a Treasurer voted on, and in place when the application is filed.  
  • Maybe 5 0r 6 other members that are not on a committee but attend meetings, good place for a Wellington person or Quinn’s Crossing, they don’t have a job they are doing but can give helpful input
  • Jennifer has a friend who is an attorney and has set up others, she will reach out for advice
  • Don’t have to file federal paperwork unless you do over 25K but must have backup paperwork to prove it,  has to be tracked as you could have a temporary cash balance over that and have to file a 1099 but shouldn’t be liable for taxes,  
  • Create by-laws and have the members sign, will need for the bank account to be opened
  • Create a mission statement  

Note: Bylaws and chapter guidelines, things that are legally necessary should be in the by-laws, and there are things that shouldn’t be there as by-laws have to be amended by everyone voting on it. Guidelines show how you are going to do things, very important how monies are handled, Bekie can provide an example of by-laws and guidelines from the fruit club.

Neil & Jennifer will get the information for next meeting to move forward with the 501C

Leads need to be cautious as one person may tend to take on too much and things fall through the cracks.  Communication is difficult and miscommunication happens when we are not vigilant.

UGA Committee: James Hansen

UGA-Urban Growth Area GMA-Growth Management Act PDS – Planning & Development Services

Past – where it began

  • Washington state saw that uncoordinated development hut the environment and sustainable economics
  • The GMA is a state law that requires state and local governments to manage Washington’s growth by identifying and protecting critical areas and natural resource lands, designating urban growth areas, preparing comprehensive plans and implementing them through capital investments and development regulations. This approach to growth management is unique among states. Known as the GMA, the Act (Chapter 36.70A RCW) was adopted by the Legislature in 1990.
  • As of September 23, 2014, the PDS showed a meager 4% growth in small towns and had no plans on increase of populations in Maltby.

Present – What this means today

  • The GMA/UGA affords us no way after the fact to go back and change a decision, only input during the changes (public notice and hearings)
  • The GMA  was designed for cities and counties to work together to build a plan for the Urban Growth Areas and will not afford the City governmental services extend into rural areas.
  • Maltby is unincorporated and so had no say in what the county plans were and has no legal grounds to stand on.
  • The GMA will allow areas adjacent to an Urban area (this will be classified as urban when complete) to be consumed and rezoned with notice (500ft) and hearings

Future – where is this going

  • We, as independent citizens and landowners have very little power outside the judgments from lawsuits we file and even in those cases the county may ignore or overlook portion s of the order
  • If Maltby is to stay what it is, we must make some changes
    • Make our voices heard loud, clear and often – not angry
    • Use the Media
    • Fight this in court
    • Incorporate so we can stand up to the county

Actions:

  • Attend all Council Meetings  held in Everett 9am on Wednesdays and utilize your 3 minutes
  • Need a list of topics and people to volunteer to attend and speak each week – contact James
  • Need to contact Channel 5 and see if we can generate interest in our fight (Veronica Jassman)

Traffic Committee:

Steve Cruver has offered to take on the responsibility as the lead for this group.

  • Plans for 522 that were posted are outdated, people in Monroe are also concerned about 522.  There are three ways out of Monroe and PLR/522 is a major one.
  • There are no grocery stores, would have to go to Woodinville, Monroe or
  • Bostian is a main thoroughfare and was not meant for this kind of traffic, it is also a Bicycle Route
  • Apartment would require a left turn across PLK

What can we do:

  • Need to get word out, there is a billboard on 522 that is open and the cost is not too bad, lots of people would see it  (Veronica Jassman to research cost)
  • Stand with a sign at the triangle to let people know
  • if we have property on Paradise Lake Road and put up a video cam we could video it the road but with no sound to avoid invasion of privacy issues.
  • Need to get the record that shows the intersection is failing, does not meet the transportation guidelines  – should be online – can’t go in and say “you can’t do this in my neighborhood”

Note: it is already not compliant with state guidelines, how can they continue to make it worse with no mitigation until 2030 – Jennifer spoke with the Wolff representatives and from their perspective they are doing us a favor because if they put their building there it will force the DOT to fix the problem, so they feel they are on our side.  Need to make sure we are not just focusing on traffic but bring up the other items as well.

School Impact Committee – Nancy Weicheld (not present)

  • Only input school would have would be the SEPA, however they can’t stop the process.
  • Superintendents were aware of the project but the school principals were not, there is an internal communication issue there.   
  • Maltby Elementary can’t handle the influx of students.
  • Both PTO groups (Maltby  Elementary & Hidden River MS) sent out information to all the students’ parents –
  • Also impacts Monroe HS as students have to be bussed or drive to and from.
  • Schools can’t help us, but the students’ parents can –  they may be able to help with letters – talking to school groups to invite the PTA groups to get on our mailing lists.  Shelly Canby is PTA president,
  • Jennifer will reach out to Shelly Canby (PTA President) to see if we can enlist her help getting word out by email addresses or perhaps get on their agenda to speak at meeting and have people sign up for information

 

Utilities Committee: Tara Schumacher (not present)

Utilities seem to be in place and available –

The Transportation, fire, drainage and building plan review were all disapproved.  We need to know why.

Emergency Services Committee : Randy White (not present)

No Update.

Wolff Developers Committee:

Said they couldn’t do a retirement home on the property, they do build them but they are usually 5-6 acre plots, this is too large a land piece – economics are different

if the deal falls through and they sell the land it could have something different built on it, the this Wolff group builds apartments –

Alternative Development possibilities:

Possibly build high School

Legal Council Committee: Jeff Lupp (Not present)

  • need to wait, too early in process, they are collecting names of  possible attorneys
  • Limit number of people who can contact the attorney to limit costs and duplication

Sale of property Committee

  • Nothing new, Taylor group put the package together and sold the property.  

Communication/Web Committee: Heather Young/Jeremy McKenzie

Teams need to provide links to be posted to Jeremy

Three things we need from each group:

  1. Are we blocked in progress and need help from another group
  2. Do we have anything that is a game changer that might shift things
  3. Are there things that need to be posted to the site to team members or to general public

An action item area needs to be on the site.

Utilizing Google Drive

How to structure the site from who is involved –

  • Public – people who visit the site to see what we are about and how to get involved –
  • Committee leads – Keepers of the knowledge
  • Members – that we delegate things to and need to keep informed
  • Safeguards against people like the Wolff Company who want to see what we are doing and we don’t want them to be able to see too much –

We have Word Press, that we can use to separate all the factions of information –

Issues:

  • How comfortable are we with Google drive – want to make people comfortable with going to the site and get the data you need,  – Jeremy will help you to get to that point and try not be a bottleneck of the information. –
  • looking for a good way to have tasks that expand to multiple teams – need to be able to search and find things related to what we are doing –
  • It will be about 2 weeks before the site is at about 80% of what we want and the rest we will discover as we go along – Jennifer will work with Jeremy

How it will be set up:

  • it will be a separate forum interface that just the leaders would have access to –
  • the other member site will be taken down, all information will be moved over –
  • All members will have to log in and we will have some hidden channels for the leads
  • We need  to know when someone emails us if they are legitimate – new people must be vouched for – need to have physical address as well as email –
  • Leads need to be able to manage their teams on the site – to ask question or give information to complete a form to submit. – will be able to delegate and post information and set meetings –
  • need to be very cautious, don’t want to get a troll on the site which can cause legal issues and mislead people
  • Allow members to unsubscribe, make a difference between being a follower (email list) or a member (Joiner) and have an easy way to remove them.  Application form to be a member must have a committee lead refer them.  
  • Files not to be share with just anyone and need to prevent possible deletion of documents. Jeremy will test the system to be sure safeguards are in place.  
  • The site only allows 1 owner, 1 administrator, 1 can edit. – restricting what access everyone has – whoever the owner of the files are should be able to keep a copy always

Other Notes:

  • Jeremy be Administrator, he will populate it
  • Members can share a folder with someone, but they cant sign into the google account to see other documents
  • Leads will want access to certain documents through Word Press – want to make site user friendly –will have to make changes as we go, open to feedback.

Politics:

  • Senator Palumbo, have to be careful how we use his name (he wants to be kept in the loop) because as a political figure he is good to have in our back pocket, we don’t want to burn the bridge.  
  • Facebook Page: Guy Palumbo put money into Jeff’s page (sponsored add) and there is a concern that it could be construed that what is posted there is attached to Guy. Don’t know who is monitoring the site for sure,
  • Facebook page should not allow posting but direct people to the web page – everything should be approved to post – Jeff is considering if he will give access to the teams or we disassociate from it.  Same with the neighborhood site –
  • Hesitant to get involved with any politicians at this point,  they can apply pressure to council members, we don’t want road fixed now, it needs to be delayed until this is settled.
  • All politicians should be advised what we are doing and maybe members can meet them and make sure they understand.

  • Hindu Temple request but no further action
  • Northshore school district bought 32 acres on Maltby road, (have site plans for HS, so maybe build a Jr. Hi for now and a HS later)  
  • Carousel Ranch purchased for the park,
  • Waste management site on Broadway,
  • Iris farm replaced by winery (across the street) 10 acre
  • McKenny site has been purchased. Build wine producing site.

 

Comments:

  • Design for the complex is awful, looks like a prison, no overhangs, nothing.  Design standard are poor.  
  • Fortera, a group to bring appropriate development, buy up land for community use.  School agricultural plots.  Major issue will be Traffic which is solvable.  See the PCB – the land is used for commercial business – not residence – the intent is pretty clear.  Does not say anything about adding additional residences. The use of the property goes against the PCB.
  • 2 different parts of government, 1 does zoning and one does the planning (PDS)
  • Notice only refers to Maltby does not say what property on the zoning.

 

Communications Committee: Heather Young (not present)

  • No Update

PLR Garden Apts – SnoCo Website

Thank you for including Councilman Low on your email. We have received several emails addressing the same concerns. Sam has driven 522 and is very aware of the traffic congestion in this area. Councilman Low has already had meetings with state and city representatives to see what options are out there to address this issue sooner rather than later. We also want to let you know we (Sam Low’s office) will be setting up a community forum in January/February with local leaders and the state to discuss possible solutions/alternatives to address the traffic issues of 522.

Hello Maltby Neighbors!

Many of you may already be aware of the proposal to build a 360 unit apartment complex at 9321 and 9509 Paradise Lake Rd just east of Hwy 522.

The neighborhood will be holding an informational and planning meeting this coming Monday, December 12 from 6:30-8:30pm at the Shepherd of the Hills Lutheran Church (9225 212th St SE, Snohomish, WA 98296). We would welcome your participation.

*Please note that on Dec. 14, 6:30pm there is also an Open House at the Brightwater facility hosted by the *developers*, the Wolff Company. It will likely be a chance for one-on-one interactions addressed to Wolff but not necessarily a group Q&A, time to address the county, or an opportunity to come together as a community to better understand the potential impact of this development.
